SWFL Vacations Vendor & Experience Provider Terms

These terms apply in addition to the Terms of Service and your signed Vendor Agreement. Capitalized terms have the meanings given in the Terms of Service. If these terms conflict with your signed Vendor Agreement, the Vendor Agreement controls.

V1. Scope#

These terms apply to anyone who lists:

  • Services, where you come to the Guest's location. Examples include private chefs, catering, prepared meals, massage and spa, makeup, photography, personal training, and car rental or delivery.
  • Experiences, which are activities at your location or a meeting point, usually lasting 1.5 to 4 hours. Examples include boat charters, jet ski and water sports rentals, fishing and wildlife tours, art workshops and cultural tours.

You are an independent business, and you alone are responsible for delivering what you list.

V2. Licenses and credentials#

You must hold every license, permit and credential your activity requires, keep them current, and upload proof when we ask. We may verify your credentials and remove your listing if proof is missing or expired. Depending on your activity, we expect to see:

V3. Insurance#

You must maintain commercial general liability insurance of at least $1,000,000 per occurrence and $2,000,000 aggregate. You must also maintain, as applicable to your business:

  • marine or protection and indemnity coverage of at least $1,000,000 for vessel operations
  • professional liability coverage for massage, spa and personal training
  • commercial auto coverage for vehicle services
  • product liability coverage for food
  • workers' compensation as Florida law requires

Name SWFL Vacations LLC as an additional insured where your carrier allows, and provide certificates on request and at each renewal.

V4. Safety and waivers#

You must operate safely and follow all laws, including U.S. Coast Guard and Florida Fish and Wildlife Conservation Commission rules on life jackets, capacity and weather. You may require participants to sign your own waiver or release, and you must describe that requirement in your listing. SWFL Vacations may show your waiver to Guests before or after booking, but we do not draft it and are not a party to it. You must cancel or reschedule when weather is unsafe. When you do, the Guest receives a full refund or a rebooking, at the Guest's choice.

V5. Listing accuracy#

Your listing must describe the duration, meeting point, what's included and excluded, any age, weight, health or swimming requirements, accessibility, group size, cancellation terms, and any add-on costs. The total price, including all mandatory fees, must be shown upfront.

V6. Services at Guest properties#

When you enter a property booked through the Platform, or any Guest's lodging, you must follow its house rules and occupancy limits and must not cause damage. You are responsible for any damage you cause. You may not sell or offer unlisted services on site to get around the Platform.

V7. Fees, payouts and Stripe#

Your commission rate is set in your signed Vendor Agreement. The commission and Stripe's payment processing fees are deducted from your payouts. Payouts are released 24 hours after the scheduled service or experience ends. The payout, set-off, hold and Stripe provisions in Host Terms H8 and H9 apply to you as if "Host" read "Vendor." You are responsible for sales tax on taxable goods and services, such as prepared food and certain vehicle rentals.

V8. Cancellations#

If you cancel a confirmed booking, the Guest receives a full refund. You earn nothing on the booking and owe SWFL Vacations the full commission on it. This does not apply if you cancel because of unsafe weather, a safety issue, a documented emergency, or another reasonable circumstance we accept. We may also lower your search placement after repeated cancellations.

V9. Other terms that apply to you#

Host Terms H13 (anti-circumvention), H15 (reviews), H16 (nondiscrimination) and H18 (term and termination) apply to you. Your indemnity under H17 also applies, and it expressly includes injury, illness, drowning, allergic reaction, vehicle accidents and property damage arising from your services or experiences.

V10. Recommendations on stay pages#

We may recommend your business on Guest stay pages and in local guides. Placement is at our discretion and may depend on performance, reviews or paid promotion. Paid placement is labeled as sponsored.
